Wage And Hour Laws in the State of California

One of the most often violated wage and hour laws in California revolves around providing a minimum wage for employees. As of January 1, 2021, the minimum wage is as follows:

  • $14.00 per hour if an employer has 26 or more employees.
  • $13.00 per hour if an employer has 25 or fewer employees.

Minimum wage increases will continue at $1.00 an hour each year until 2023, which will cap out at $15.00 an hour for every worker, regardless of how many employees there are within an individual company.

In addition to minimum wage law violations, we also know that employers in California regularly try not to pay their workers the overtime they are entitled to. Under California law, all non-exempt employees are entitled to overtime pay if they work more than 8 hours in a single day or more than 40 hours in a single workweek. Overtime pay in California is time and a half (1.5) of their regular wage. Additionally, workers in this state will be paid double their regular wages if they work more than 12 hours in a single day or more than 8 hours on the seventh consecutive day during the workweek.
